If a couple wants to marry in China, it is necessary to register to the authorities of civil affairs. According to Law of the people’s Republic of China on marriage, the minimum age is 22 years for men and 20 years for women. But the average age of marriage has continued to increase in recent years in large cities. The annual report on marriage published by the municipality of Shanghai shows that the average age was 32,45 years for men and 29,77 years for women in 2010, 0.4 year more than in 2009. According to the ministry of civil Affairs, 1.71 million couples filed for divorce in 2009, 10.3 percent more than in 2008. According to the chinese Association of research on youth and the family, 30 % of the marriages of the generation born in the 1980s will fail. In the case of divorce, the custody of children is negotiated between the parents, failing which the decision is taken by the court. Preliminary negotiations also take place on the separation of property, before the court gives its verdict. If none of the spouses has committed misconduct moral or legal, goods-in-transit is divided to 50 %. If a married couple wants to have a child, it is necessary to get permission for birth when the woman is pregnant. Generally, an unmarried couple can’t have children legally nor obtain identity card for the child.
