The use of the electronic cigarette in the working space, closed and covered, for collective use is forbidden since the 1st of October. The use of the electronic cigarette in the working space, closed and covered, for collective use is prohibited by article L. 3513-6 of the labour code from January 2016. A decree of April 25, 2017 defines in detail the work locations affected by the ban, it make it mandatory for its signaling apparent (no model defined ; the employer is free to choose the form it may take), and provides for fines in case of breach of these provisions.
The prohibition of vaping applies to local receiving stations :
– situated or not in the school buildings ;
– closed and covered ;
– assigned to a collective use.
However, the locals who greet the public are excluded from this prohibition.
The employees will thus be able to continue to vape in peace :
– in their individual office, unless otherwise specified in the rules of procedure ;
– in working premises is open to the public : as reception areas.
Vape in a place forbidden, shall be punished by a fine of 150 euros.
The lack of implementation of a signaling by the employer is, as such, punishable by 450 euros.
